01Who runs this site

wayofthetrader.com ("the site") is operated by Creas Solutions Marek Kaliszuk, ul. Cynamonowa 9/2, 64-130 Nowa Wieś, Poland, tax ID (NIP) 4970066823 ("the operator", "we"). Contact: contact@wayofthetrader.com.

These Terms of Use govern your use of the site, the newsletter, the contact form and the software tools published on the site. They are also the terms and conditions for services provided by electronic means within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means. They are available free of charge before you use any service, and you can save or print them at any time.

The Risk Disclosure and the Privacy Policy form part of these Terms.

02Services

The operator provides the following services free of charge:

1. Access to content: articles, news, the economic calendar, embedded videos and other pages of the site.
2. Contact form: sending a message, question or bug report to the operator.
3. Newsletter: periodic emails with new content and tool updates.
4. Software tools: downloadable add-ons and indicators, licensed under section 9.
5. Donations: the option to support the site with a voluntary donation through a third-party payment provider.

03Technical requirements

To use the site you need a device with internet access and a current version of a common web browser (for example Chrome, Firefox, Safari or Edge). Forms work best with JavaScript enabled. The newsletter requires an active email address. Software tools require a Windows computer with a current version of NinjaTrader 8, and any platform license, data feed and brokerage or prop firm connection required by NinjaTrader and your provider under their own terms.

04Starting and ending the use of a service

• Access to content: the agreement starts when you open a page and ends when you leave the site.
• Contact form: the agreement starts when you send a message and ends when the message has been handled.
• Newsletter: the agreement starts when you submit the signup form (and confirm your address, if a confirmation email is sent) and lasts until terminated. You can terminate it at any time, free of charge and without giving a reason, using the unsubscribe link in any email or by writing to contact@wayofthetrader.com. We can end the newsletter or your subscription with at least 14 days' notice by email, or immediately if you breach section 5.
• Software tools: the license agreement starts when you accept these Terms and download a tool. You can end it at any time by deleting the tool. It ends automatically if you breach section 9.

05Your obligations

When using the site you must not:

• provide content that is unlawful, infringes the rights of others, or contains malware;
• send spam, advertising or bulk messages through the contact form;
• attempt to gain unauthorized access to the site, its server or its data, or interfere with its operation (including load testing, vulnerability scanning without permission, and automated harvesting that places an unreasonable load on the server);
• impersonate another person;
• use the site or its tools in breach of the law or of the rules of your broker, platform vendor or prop firm.

06Education, not advice

All content is general education. It is not investment, financial or trading advice and is not tailored to you. Trading futures involves substantial risk of loss. Any trading results shown on the site come from simulated prop firm accounts. The full statement, including the disclosure required by CFTC Rule 4.41, is in the Risk Disclosure, which you should read before acting on anything published here.

07Accuracy and changes to content

We write carefully and correct errors when we find them, but content may be incomplete, outdated or wrong, especially information about third-party rules, prices and schedules. We may change, update or remove any content, page or tool at any time.

08Intellectual property

Texts, images, charts, videos, tool code and the Way of the Trader name and design are owned by the operator or used under license, and are protected by copyright and other laws. You may read, print and save content for your own personal, non-commercial use, and you may quote short fragments with a clear credit and a link to the source. Any other copying, republishing, translation, redistribution or use to train or build commercial products requires prior written permission.

09Software license

This section applies to every software tool downloaded from the site (a "tool"), including trade copiers, risk managers, indicators and add-ons for NinjaTrader 8.

9.1 License

We grant you a free, personal, non-exclusive, non-transferable, revocable license to install and use a tool on computers you control, with trading accounts that you own or are authorized to operate.

9.2 Restrictions

You must not:

• sell, rent, sublicense, redistribute or publish a tool or its files (share the link to the tool page instead);
• remove or alter copyright or license notices;
• decompile, disassemble or modify a tool, except to the extent the law expressly allows it despite this restriction;
• use a tool to copy, mirror or execute trades in accounts belonging to other people, or to provide a trade copying, signal or account management service to anyone.

9.3 What a tool does and does not do

A tool executes or displays only what you configure and instruct. It does not make trading decisions, does not provide advice, and does not guarantee any result.

9.4 Your responsibilities

Before and while using a tool, you are responsible for:

• testing it on a simulation account in the same configuration you intend to use;
• checking its configuration before each session;
• monitoring your positions and orders on every account at all times, and being able to manage or flatten them directly in your platform or with your broker if the tool fails;
• making sure your broker's, platform vendor's and prop firm's rules allow the way you use the tool. Many prop firms restrict copy trading, trading across multiple accounts or firms, and automated trading;
• keeping your platform, connection and computer in working order.

9.5 Known limitations

Like any trading software, a tool can fail. Causes include software bugs, NinjaTrader updates, connection or data interruptions, rejected or partially filled orders, latency and configuration errors. A failure can result in orders not being copied, being copied incorrectly or more than once, or positions being left without protective orders, and can cause losses, failed evaluations or rule breaches.

9.6 Third-party platforms

NinjaTrader is a product of NinjaTrader Group, LLC. The tools are independent and are not affiliated with, endorsed by or supported by NinjaTrader or any broker or prop firm. Their terms, fees and availability are outside our control.

9.7 Updates and discontinuation

We may release updates, change features, or stop providing or supporting a tool at any time. Versions marked beta or pre-release may be less stable.

9.8 End of license

The license ends if you breach this section. When it ends, you must stop using the tool and delete it.

9.9 No warranty and liability

Sections 12 and 13 apply in full to the tools.

10Affiliate links and third-party sites

The site links to third-party websites, including prop firms and software vendors. Some links are affiliate links and are labeled: if you buy after following one, the operator may receive a commission at no extra cost to you. Any purchase or agreement you make with a third party is solely between you and that third party, under its terms. We are not responsible for third-party websites, products, rules, payouts or decisions.

11Donations

Donations are voluntary gifts made through a third-party payment provider under that provider's terms. A donation is not a purchase and does not entitle you to any product, service, content, priority or influence over what is published. If you made a donation by mistake or in the wrong amount, write to contact@wayofthetrader.com within 14 days and we will refund it. Any other rights you have under mandatory law are not affected.

12No warranty

To the extent permitted by law, the site, its content and the tools are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, availability, fitness for a particular purpose and non-infringement. We do not warrant that the site or any tool will be uninterrupted, error-free or secure.

13Limitation of liability

To the extent permitted by law, the operator is not liable for any loss or damage arising from the use of, or inability to use, the site, its content or the tools, including trading losses, missed trades, failed evaluations, account closures, fees paid to third parties, lost profits or lost data.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for damage caused intentionally or through gross negligence, or any rights you have as a consumer under mandatory law.

14Complaints

If a service does not work as described in these Terms, you can file a complaint by email to contact@wayofthetrader.com or through the contact form (topic: "Bug on the site" or "Other"). Please include your email address, a description of the problem, and the date and page or tool concerned. We will reply by email within 14 days of receiving the complaint. If the complaint is missing information we need, we will ask you for it and the 14 days will run from when we receive it.

15Risks of using online services

Using any online service carries risks such as malware, phishing, spam and unauthorized access to your device or accounts. Keep your operating system, browser and antivirus software up to date, download tools only from this site, and be careful with links in emails. We will never ask you for passwords, login details or payment card data for your broker, platform or prop firm accounts. If you receive such a request in our name, do not respond and let us know.

16Governing law and disputes

These Terms are governed by Polish law. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you habitually reside. Disputes will be resolved by the court competent under the applicable rules, and consumers can bring proceedings in the courts of their place of residence where the law allows it. Consumers may also use out-of-court complaint and redress procedures available under the law of their country.

17Changes to these Terms

We may change these Terms, for example when we add a service or a tool, or when the law changes. The version number and date at the top always show the current version. Material changes will be announced on this page at least 14 days before they take effect, and newsletter subscribers will also be informed by email. If you do not accept a change, you can end the relevant agreement under section 4. Changes do not apply to actions taken before they take effect.
